The Atlanta Journal Constitution reports that a Georgia cap limiting non-economic damages in medical malpractice cases has been found unconstitutional by a Fulton County Superior Court Judge because it unfairly protects the medical profession. 

The Judge found that the $350,000 cap on non-economic damages provides less protection for citizens injured in medical settings than is provided to those in other settings.
